SB2457 Summary

• Amends the Developmental Disability and Mental Disability Services Act to establish a new Article XII addressing community-based services for persons with developmental disabilities.

• Authorizes transition to community-based services for adults over 18 who qualify for Medicaid Waiver services, reside in intermediate care facilities with 9 or more residents, and affirmatively request community-based placement.

• Also covers adults in family homes who qualify for Medicaid Waiver services, need community-based services, and affirmatively request community-based placement.

• Establishes a phased transition schedule overseen by the Department of Human Services: 500 persons by June 15, 2018; additional 500 by June 15, 2019; additional 500 by June 15, 2020; additional 500 by June 15, 2021; additional 500 by June 15, 2022; remaining persons at reasonable pace thereafter.

• Protects individual choice and provider autonomy by prohibiting forced relocations of persons unwilling to move or forced facility closures and downsizing agreements against provider will.
