SB2599 Summary

• Amends the Unified Code of Corrections regarding concurrent and consecutive sentencing by modifying Section 5-8-4 (730 ILCS 5/5-8-4).

• Establishes that sentences shall run concurrently by default unless the court determines otherwise, applying to multiple sentences imposed simultaneously or sentences imposed on defendants already subject to prior imprisonment.

• Adds exceptions to mandatory consecutive sentencing for violations of electronic home monitoring conditions under Section 5-8A-4.1, which only require consecutive sentences on the third or subsequent conviction.

• Expands mandatory consecutive sentencing requirements to include convictions for using a stolen firearm (Section 24-3.7), child pornography offenses when the victim is under age 13, and various armed violence predicate offenses.

• Preserves existing mandatory consecutive sentencing rules for serious crimes including first-degree murder, Class X and Class 1 felonies with severe bodily injury, sexual assault offenses, and crimes committed by individuals in Department of Corrections custody or on pretrial release.
