Public entities are prohibited from entering into food purchase contracts with bidders whose terms restrict the entity from donating food to food banks, homeless shelters, food pantries, and soup kitchens.

Each State agency purchasing food under the Illinois Procurement Code must adopt a written policy permitting donation of leftover food procured with State funds.

State agency food donation policies must cover daily food operations and one-time events, and include a list of nearby nonprofits and charitable organizations eligible to receive donations.

State agencies must circulate their food donation policies to all employees and submit policies annually to the Department of Central Management Services beginning December 31, 2018.

The Act takes effect upon becoming law.
