IL SB2816

Amends the Illinois Procurement Code to add Section 25-90 regarding net neutrality requirements for State contracts with Internet service providers.

Prohibits State agencies from contracting with Internet service providers for broadband Internet access service unless the provider certifies under penalty of perjury that it will not block lawful content, impair lawful traffic, engage in paid prioritization, or unreasonably interfere with customer choices.

Requires Internet service providers to not engage in deceptive marketing practices misrepresenting traffic treatment and to prominently disclose all service aspects when advertising or selling broadband Internet access.

Defines key terms including "broadband connections" (exceeding 200 kilobits per second), "broadband Internet access service," "Internet service provider," and "paid prioritization" (preferential traffic management for consideration or to benefit affiliated entities).

Allows reasonable network management practices as an exception to the restrictions on blocking and impairing lawful Internet traffic.
