IL SB2818

Adds a new definition of "indigent" to the Code of Criminal Procedure that includes persons receiving specified public benefits, persons with income at or below 125% of federal poverty level, or persons unable to afford court fees without substantial hardship.

Specifies that posting bail by a defendant shall not be considered as a factor in determining eligibility for Public Defender appointment.

Modifies Section 113-3 regarding right to counsel for indigent defendants in criminal cases to incorporate the new definition and bail-posting provision.

Takes effect immediately upon becoming law.
