Changes employer participation in health savings account programs from mandatory ("shall") to optional ("may") under the State Employee Health Savings Account Law.

Removes the requirement that employers annually deposit an amount equal to one-third of the annual deductible into eligible employees' health savings accounts.

Allows employers who offer health savings account programs to make voluntary annual contributions in amounts determined by the employer, rather than a fixed formula.

Permits eligible individuals to continue depositing their own contributions into health savings accounts in accordance with existing restrictions.

Unused funds in health savings accounts remain the property of the account holder at the end of each taxable year.
