IL SB2912

Amends Section 9-113 of the Illinois Highway Code to require entities applying for consent to use highway property to pay damages to property owners when the highway authority lacks fee ownership or the right to grant use of the property.

Damages must be agreed upon by the entity and property owners or ascertained and paid through eminent domain procedures.

Applies specifically when property is located over or under a highway or road and the highway authority cannot authorize its use.

Takes effect immediately upon becoming law.
