SB3002 Summary: Innovations for Transportation Infrastructure Act

• Creates the Innovations for Transportation Infrastructure Act authorizing the Illinois Department of Transportation and Illinois State Toll Highway Authority to use design-build and Construction Manager/General Contractor project delivery methods as alternatives to traditional design-bid-build procurement for transportation facilities.

• Limits use of alternative delivery methods to no more than 20% of the Department's multi-year highway improvement program (5-year rolling average, 30% maximum in any single year) and 20% of the Authority's annual improvement program, with the Department capped at 2 Construction Manager/General Contractor projects.

• Establishes two-phase procurement process for design-build projects (qualifications then proposals) with shortlisting of 2-5 most qualified proposers, or single-phase procurement for projects under $5,000,000 or with written determination by the Secretary or Executive Director.

• Requires Transportation Agencies to conduct best interests analysis before procurement, maintain records and confidentiality of proposals until contract execution, and comply with prevailing wage, minority/disadvantaged business enterprise, and federal requirements.

• Allows Alternative Technical Concepts to be submitted in design-bid-build projects (maximum 3 projects for Department) and permits use of any lawful funding source; effective immediately.
