SB3005 Summary

• Increases the deadline to commence judicial review of final administrative decisions from 35 days to 60 days from service of the decision.

• Creates a new right to judicial review for persons suffering legal wrong or adversely affected by administrative decisions that are either made reviewable by statute or final decisions with no other adequate remedy in court.

• Changes references from "parties" to "persons" throughout the Administrative Review Law to broaden the scope of who may seek judicial review.

• Modifies the scope of judicial review by removing the presumption that administrative agency findings are prima facie true and correct, and clarifies that courts may review all questions of law and fact.

• Expands the circuit court's powers to include holding unlawful and setting aside administrative decisions that are arbitrary, capricious, an abuse of discretion, contrary to constitutional rights, in excess of jurisdiction, without observance of required procedures, or unsupported by substantial evidence.
