SB3066 - Good Samaritan Food Donation Act

• Repeals the existing Good Samaritan Food Donor Act and replaces it with the Good Samaritan Food Donation Act.

• Provides liability protection for persons, gleaners, and nonprofit organizations who donate apparently wholesome food or apparently fit grocery products from civil and criminal liability, except in cases of gross negligence or intentional misconduct.

• Protects property owners who allow collection or gleaning of donations on their property from liability for injury or death of gleaners or nonprofit representatives, except for acts constituting gross negligence or intentional misconduct.

• Allows donors to claim immunity from liability for non-compliant food and grocery products if the receiving nonprofit organization is informed of the defective condition, agrees to recondition the items to compliance standards, and is knowledgeable about proper reconditioning procedures.

• Does not create new liability and does not supersede state or local health regulations; effective immediately upon passage.
