SB3086 Summary

• Amends the Intergovernmental Cooperation Act to allow appointed officials, in addition to elected officials, to serve as Directors on Municipal Joint Action Water Agencies established after the effective date of this act.

• Allows Directors of newly established Municipal Joint Sewage Treatment Agencies to be appointed officials rather than requiring them to be elected officials of member municipalities or counties.

• Maintains existing provisions for water agencies to plan, construct, operate, and finance joint waterworks systems, and to issue revenue bonds and notes with a maximum term of 50 years.

• Preserves authority for water agencies to issue general obligation bonds up to 5.75% of taxable property value in the service area, subject to voter approval by referendum.

• Retains prohibitions on water agencies providing direct service to residents within municipalities or within one mile of municipal corporate limits without written municipal consent.
