SB3099 Summary

• Amends the Student Online Personal Protection Act to allow national assessment providers to sell or rent student information if they obtain express written consent from the student or parent/guardian through clear notice, and use the information solely for employment, educational scholarships, financial aid, or post-secondary educational opportunities.

• Expands permissible research uses of student covered information to include legitimate research purposes required or allowed by state or federal law in furtherance of K-12 school purposes or post-secondary educational purposes, removing the previous requirement for school district or State Board of Education direction.

• Maintains the requirement that no covered information used for research purposes can be used for advertising or to build profiles on students for non-K-12 purposes.

• Takes effect immediately upon becoming law.
