IL SB3102

Amends the Consumer Fraud and Deceptive Business Practices Act to regulate marketing and advertising of mental health disorder and substance use disorder treatment services.

Prohibits misleading or false advertising that misrepresents the need to seek mental health or substance use disorder treatment outside of Illinois.

Requires marketing materials directed to Illinois residents to display: full physical address, Illinois licensing status, in-state locations, insurance coverage information, in-network/out-of-network status, links to state agency resources, and disclosure that treatment may be available at reduced cost or free within Illinois.

Prohibits referral arrangements where patients are referred to treatment facilities in exchange for fees, revenue percentages, or remuneration based on referral volume or value; such violations also constitute fee-splitting violations under the Medical Practice Act and Health Care Worker Self-Referral Act.

Exempts health insurance companies, health maintenance organizations, managed care plans, hospitals, and hospital affiliates licensed in Illinois from the referral arrangement prohibitions.
