SB3138 Summary

• Amends the Freedom of Information Act to exempt personal identity and address information of scholarship, grant, and financial assistance applicants and recipients under non-discretionary programs administered by the Higher Education Student Assistance Commission from public disclosure.

• Specifies exemption applies to programs including the Monetary Award Program where eligibility data comes from the Free Application for Federal Student Aid (FAFSA) or is otherwise protected under federal or state law.

• Adds Section 70 to the Higher Education Student Assistance Act to codify that such personal identity information is intended to remain private and exempt from Freedom of Information Act inspection and copying.

• Makes conforming amendments to the Freedom of Information Act's statutory exemptions list to reference the new section and add exemption for information prohibited under the Seizure and Forfeiture Reporting Act.
