SB3208 Summary

• Amends Illinois Municipal Code Section 11-31-1 regarding demolition, repair, enclosure, or remediation of dangerous and unsafe buildings with a technical change to the opening language.

• Municipalities may demolish, repair, or enclose dangerous/unsafe or uncompleted/abandoned buildings and remove hazardous materials, with county boards having similar powers in municipalities under 50,000 population.

• Property owners and tenants within 1,200 feet of unsafe buildings in municipalities with 500,000+ population may request municipal action or bring lawsuits if the municipality fails to act within 90 days.

• Municipalities may place liens on properties for costs incurred in remediation work, with liens superior to most prior liens except taxes, and may foreclose on these liens through court proceedings.

• Municipalities may inspect, test, and remediate hazardous substances and petroleum products on abandoned properties, with costs recoverable through liens that may be foreclosed.
