SB3217 Summary

• Amends the Freedom of Information Act to extend exemptions for records requested by persons committed to the Department of Corrections or Department of Human Services Division of Mental Health to also include the Department of Human Services Division of Mental Health.

• Expands existing exemptions (e-5, e-6, e-7, e-8, e-9, e-10) that restrict access to records by incarcerated or committed individuals to explicitly include those committed to the Department of Human Services Division of Mental Health, not just the Department of Corrections.

• Maintains restrictions preventing access to library materials available in facilities, staff personnel files and rosters, materials available through administrative requests, records that could risk harm or escape, victim information, and law enforcement records of other persons.

• Applies these expanded protections consistently across exemptions related to materials in facility libraries, staffing information, administrative availability, safety risks, victim privacy, and other persons' law enforcement records.
