Carnival and amusement enterprise owners cannot employ workers convicted of crimes in Article 11 (sex offenses) or Article 9 (crimes against persons) of the Criminal Code, or registered sex offenders, effective January 1, 2008

Owners must conduct criminal history records checks and National Sex Offender Public Registry checks at time of hire and annually thereafter, with exemption for workers under age 17

Owners must implement a substance abuse policy that includes random drug testing of carnival and amusement workers

First violation results in civil penalty up to $5,000, second violation up to $10,000, and subsequent violations result in revocation of operating permit

Owners must maintain records of background checks, substance abuse policies, and other compliance documentation available to the Department upon request
