SB3256 Summary

• Amends Section 24-3 of the Criminal Code of 2012 regarding unlawful sale or delivery of firearms.

• Expands the 72-hour waiting period for concealed firearms to apply to all firearms (not just concealable ones) and clarifies that stun guns and tasers require a 24-hour waiting period.

• Removes the exemption allowing sales to nonresidents of Illinois at firearm shows or displays recognized by the Illinois Department of State Police.

• Adds criminal liability for adults 18 and older who sell or give firearms to minors under 18 if that firearm is used in committing or attempting to commit a forcible felony.

• Establishes varying felony charges and sentences for unlawful delivery of stolen or converted firearms based on the number of firearms delivered and timeframe (ranging from Class 2 to Class X felonies with sentences from 6 to 60 years).
