SB3287 Summary

• Replaces the reimbursement system for long-term care facilities for persons under 22 years with a new system for medically complex for the developmentally disabled (MC/DD) facilities licensed under the MC/DD Act, effective July 1, 2018.

• Sets reimbursement rates for MC/DD facilities at a minimum base rate of $216 per diem, with exceptional care rates of Tier 1 ($255), Tier 2 ($569), and Tier 3 ($765) for residents with complex medical needs including feeding tubes, tracheostomy care, and ventilator dependence.

• Requires MC/DD facilities to document resident conditions and services in medical records using Minimum Data Set standards to qualify for exceptional care reimbursement instead of submitting assessments to the Department.

• Transfers reimbursement calculations and direct payment responsibility from the Department of Human Services to the Department of Healthcare and Family Services.

• Imposes an assessment and licensing fee on MC/DD facilities and creates the Medically Complex for the Developmentally Disabled Provider Fund to receive and disburse these moneys for payments to qualifying facilities and federal reimbursement obligations.
