IL SB3616

Amends the Consumer Fraud and Deceptive Business Practices Act by adding the "Cell Phone Lemon Law" to protect consumers who purchase wireless phones with service contracts.

Allows consumers to cancel their wireless service contract without early termination fees if a phone requires repair or replacement 3 or more times during the contract period.

Permits consumers to alternatively upgrade or downgrade their phone without renewing or extending the contract, paying only the price difference for upgrades or receiving a credit for downgrades.

Requires wireless telephone service providers to give consumers a written statement of their rights under this law at the time of sale.

Excludes repairs for damage caused by consumer action (water damage, physical impact, broken casing, forced components) and service quality issues from the law's protections, with violations deemed unlawful practices.
