HB0011 - Biological Specimen Guardianship Act

• Creates the Biological Specimen Guardianship Act allowing courts to appoint a guardian over a biological specimen if the petitioner is a descendant of the specimen's source and the specimen was obtained/used in violation of 45 CFR 46.116 (federal human subjects protection regulations).

• Grants guardians authority to consent or refuse consent to specimen use, ensure specimen use protects privacy, and seek compensation for prior unauthorized specimen use.

• Eliminates standard statutes of limitation and repose for actions under this Act, allowing cases to be filed at any time.

• Establishes that any applicable statute of limitation or repose for unauthorized specimen use begins running from the date a guardian is appointed under this Act.
