Persons convicted of financial exploitation, abuse, or neglect of elderly persons or persons with disabilities are barred from inheriting property or receiving benefits from the victim's estate in any capacity.

Persons found civilly liable for financial exploitation by a preponderance of the evidence are subject to the same inheritance restrictions as those criminally convicted.

The victim may still transfer property to the convicted or civilly liable person if they knew of the conviction or finding and subsequently expressed intent to do so by clear and convincing evidence.

Financial institutions and similar entities are not liable for distributing property prior to conviction or finding of liability, but must not knowingly distribute after receiving written notice of conviction.

Courts may discretionally reduce rather than eliminate inheritance interests for persons found civilly liable for financial exploitation based on relevant facts and circumstances.
