Creates the Medical Device Safety Act requiring all medical devices used by, surgically applied to, or implanted within patients in Illinois to be under warranty, regardless of the patient's medical condition severity

Manufacturers, sellers, and providers of medical devices are liable for all replacement costs when a device malfunctions through no fault of the patient

Hospitals and ambulatory surgical treatment centers must waive costs charged to patients for follow-up surgeries resulting from defective medical devices

Amends the University of Illinois Hospital Act, Ambulatory Surgical Treatment Center Act, and Hospital Licensing Act to require all covered facilities to waive costs for follow-up surgeries resulting from previous surgical errors at that facility

Takes effect immediately upon becoming law
