Seizure Smart School Act (HB1475) Summary

• Requires all school employees to receive inservice training on seizure recognition, first aid, and emergency protocols consistent with Centers for Disease Control and Prevention guidelines.

• Establishes "seizure action plans" for students with epilepsy that specify needed services and delegate authority to trained "delegated care aides" to provide epilepsy-related care at school and school-sponsored activities.

• Permits students with epilepsy to possess epilepsy treatment supplies, equipment, and medication on their person at all times in accordance with their seizure action plan.

• Prohibits schools from restricting student assignment or denying access to school or school activities based on epilepsy diagnosis, and prohibits retaliation against employees who decline to volunteer as delegated care aides.

• Provides immunity from civil damages for schools and employees in compliance with training requirements, except for willful or wanton misconduct, and requires charter schools to comply with the Act.
