HB1582 - Broadband Procurement and Disclosure Act

• Creates the Broadband Procurement and Disclosure Act establishing network neutrality requirements for State broadband contracts with Internet service providers.

• Prohibits State broadband purchasers from awarding contracts to ISPs that block lawful content, impair or degrade lawful traffic based on content, or engage in paid prioritization and traffic manipulation.

• Requires all Internet service providers to disclose their network management practices and commercial terms (including monthly charges, fees, and service limitations) on their websites.

• Authorizes the Attorney General and State's Attorneys to enforce the Act through civil action with authority to recover reasonable expenses, attorneys' fees, and costs from defendants.

• Exempts ISPs from the Act's requirements when addressing emergency communications, law enforcement, public safety, or national security needs consistent with applicable law.
