IL HB1633

Defines "critical infrastructure facility" to include 21 types of infrastructure (petroleum refineries, power plants, water treatment facilities, telecommunications, ports, nuclear facilities, military bases, mining operations, and others) that are enclosed by fences or clearly marked with no-trespassing signs.

Creates new offense of "criminal damage to a critical infrastructure facility" as a Class 3 felony with a $100,000 fine for intentionally damaging, destroying, or tampering with equipment at such facilities.

Expands existing criminal trespass offense to apply to all critical infrastructure facilities (previously limited to nuclear facilities) and creates new "aggravated criminal trespass" offense when trespass is done with intent to damage equipment or impede facility operations.

Sets penalties for criminal trespass to critical infrastructure as a Class 4 felony with minimum $1,000 fine, and aggravated trespass as a Class 3 felony with minimum $10,000 fine.

Exempts contractors performing authorized work, persons engaged in lawful labor disputes or union organizing, safety compliance monitoring, and lawful exercise of free speech and assembly rights from criminal liability.
