HB2026 - Digital Fair Repair Act

• Original equipment manufacturers must make diagnostic and repair documentation available to independent repair providers and equipment owners on the same terms and timeline as authorized repair providers, at no charge or on equal terms.

• Original equipment manufacturers must sell replacement parts and service parts to owners, authorized agents, and independent repair providers on fair and reasonable terms, including software updates.

• Original equipment manufacturers must make available diagnostic repair tools with the same capabilities provided to their own staff or authorized repair providers, offered for purchase at fair and reasonable terms.

• Independent repair providers must notify equipment owners in writing before service that repairs by non-authorized providers may affect warranties, that branded parts cannot be required, and that the Magnuson-Moss Warranty Act applies.

• The Attorney General may seek injunctions and civil penalties up to $500 per violation; the act excludes motor vehicles, motorcycles, and recreational vehicles; trade secrets remain protected.
