IL HB2040

Prohibits the State, local governments, and county sheriffs from entering into agreements with private entities to operate, manage, or own detention facilities.

Bars public entities from paying, reimbursing, subsidizing, or providing any financial support for costs related to private detention facility development, construction, or operation.

Prevents public entities from receiving per diem payments or other financial compensation tied to detaining individuals in privately-operated detention facilities.

Allows public detention facilities to contract with private entities only for ancillary services such as medical care, food service, education, and facility maintenance.

Takes effect immediately upon becoming law and supersedes any conflicting state laws.
