IL HB2200

Amends Illinois Vehicle Code Section 2-118.1 to require court orders rescinding statutory summary suspensions or revocations to contain a factual basis for the rescission.

Directs the Secretary of State to return any rescission order lacking a factual basis to the court and prohibits rescinding the suspension until a properly documented order is received.

Maintains existing procedures for persons to request judicial hearings within 90 days of receiving statutory summary suspension or revocation notices for alcohol or drug-related driving violations.

Preserves the scope of judicial hearings to address five specific issues: arrest validity, officer's reasonable grounds, refusal to submit to testing, chemical test results, and involvement in accidents causing Type A injury or death.
