IL HB2220

Amends the Illinois Highway Code (605 ILCS 5/9-113) to allow communications providers issued a certificate of public convenience and necessity from the Illinois Commerce Commission to use highway right-of-way upon receipt of an application.

Defines "communications provider" to include telecommunications carriers, voice over Internet protocol providers, broadband service companies, cable operators, and specified holders under the Public Utilities Act.

Requires communications providers to meet the same requirements as public utilities when highway authorities do not have fee ownership of the property, including paying damages to property owners as determined through eminent domain procedures.

Applies existing utility participation requirements for coordination councils and removal/relocation procedures to communications providers using highway right-of-way.

Effective immediately upon enactment.
