HB2315 Summary

• Amends the Illinois Administrative Procedure Act to establish requirements for service of documents by email, allowing agencies to require attorneys and licensed/regulated persons to accept email service while prohibiting email service for documents containing sensitive personal information like Social Security numbers, financial account numbers, or information about minors.

• Modifies the Illinois Identification Card Act to allow non-REAL ID identification cards and Person with a Disability cards to be invalidated when holders voluntarily surrender them, upon death, or when they refuse to correct or update information; adds new subsection clarifying that Limited Term cards must be marked for non-citizens and non-permanent residents, excluding conditional permanent residents and those with approved asylum or refugee status.

• Changes the Illinois Vehicle Code to expand Secretary of State authority to seize fraudulent or altered documents and to deny, suspend, or revoke vehicle registration for applicants who fail to disclose material information, make false statements, apply as subterfuge, or whose business is controlled by ineligible persons or those with federal out-of-service orders.

• Updates driver's license expiration rules to clarify that Limited Term REAL ID compliant licenses for non-citizens and non-permanent residents (excluding conditional permanent residents and those with approved asylum or refugee status) must be marked "Limited Term."

• Adds entry-level driver training requirements for commercial driver's license applicants seeking original or upgraded CDLs or certain endorsements, effective February 7, 2020, with exemptions for those obtaining permits before that date; requires training from federal Training Provider Registry-listed entities and completion of both theory and behind-the-wheel portions within one year.
