HB2557 - Artificial Intelligence Video Interview Act

• Employers using artificial intelligence to analyze applicant video interviews for Illinois positions must notify applicants before the interview that AI analysis will be used to evaluate fitness for the position.

• Employers must provide applicants with information explaining how the artificial intelligence works and what general types of characteristics it uses to evaluate candidates before the interview occurs.

• Employers must obtain written consent from applicants before using artificial intelligence to evaluate their video interviews; AI evaluation of non-consenting applicants is prohibited.

• Employers may only share applicant videos with persons whose expertise or technology is necessary to evaluate the applicant's fitness for the position.

• Applicants may request deletion of their interview videos, and employers must delete them within 30 days and instruct all other recipients to delete copies, including electronic backups.
