IL HB2601

Amends the Real Property Conservation Rights Act to allow conservation rights to be amended or modified only by written instrument executed by both grantor and grantee and recorded with the county recorder, with either party able to withhold consent in their absolute discretion.

Permits units of local government including counties, townships, forest preserve districts, conservation districts, park districts, and municipalities to grant conservation rights on their own property to other governmental units or not-for-profit organizations.

Expands enforcement authority to allow parties entitled to enforce conservation rights to bring actions against non-owners violating the terms, and permits holders to record a notice of violation against the property.

Protects conservation rights from extinguishment by adverse possession, abandonment, or merger, allowing termination only through procedures specified in the conservation right itself or by formal release.

Prevents prescriptive easements from being established that would adversely impact the conservation values protected by the conservation right.
