Prohibits operating or having actual physical control of a motor vehicle while anyone in the vehicle is smoking when a person under 18 years of age is present.

Defines smoking as inhaling, exhaling, burning, or carrying a lighted cigarette, cigar, pipe, weed, plant, regulated narcotic, or other combustible substance.

Establishes violation as a petty offense with a maximum fine of $100.

Exempts motorcycles and convertible motor vehicles operating in open-air or top-down mode from the smoking restriction.

Prohibits police officers from stopping a motor vehicle solely for violating this provision.
