Persons holding part-time elective office are not participating employees in the Illinois Municipal Retirement Fund unless they were elected before the effective date of this act and have elected in writing to become contributors.

An elective office is presumed part-time unless the legal advisor of the applicable municipality or instrumentality files an official job description or determination with the Fund every 4 years declaring it full-time.

Applies to part-time elective offices in any municipality or instrumentality, with the presumption favoring part-time status absent formal documentation of full-time requirements.

Grandfathers existing elected officials who were in office before the act's effective date and allows them to continue participating if they elect to do so in writing.
