Employees may request up to 30 days of leave per 12-month period to serve as a bone marrow or organ donor, with additional allowances for blood donations (up to 1 hour), double red cell donations (up to 1.5 hours), and platelet donations (up to 2 hours).

Employers are prohibited from retaliating against employees for requesting or obtaining organ donor leave, and employees cannot be required to use accumulated sick or vacation time before accessing organ donor leave.

Insurers are prohibited from denying life insurance, disability insurance, or long-term care insurance coverage to living organ donors, or charging them higher premiums solely because of their donor status.

The Secretary of State must create and maintain a database by July 1, 2020 of individuals registered in the First Person Consent organ and tissue donor registry, with online access provided to organ procurement organizations through data access agreements.

The Department must adopt rules governing organ donation leave including conditions for requesting and approving leave and requiring medical documentation before leave is approved.
