IL HB3168

Amends the Unified Code of Corrections to require presentence reports in felony cases to include information about defendant's eligibility for impact incarceration programs administered by the Department under Section 5-8-1.1.

Requires courts to make a specific finding at sentencing about whether a defendant is eligible for Department impact incarceration programs under Sections 5-8-1.1 or 5-8-1.3, and if not eligible, to provide an explanation for why impact incarceration is not appropriate.

Adds victim impact information from the victim's spouse, guardian, parent, grandparent, and other immediate family or household members to presentence reports, including any written statements which must be attached to the report.

Modifies sentencing hearing requirements to ensure courts consider substance abuse treatment eligibility screening and assessment as part of the sentencing determination process.
