HB3181 Summary

• Amends Illinois Code of Civil Procedure Section 2-619 to add a new ground for dismissal motions based on claims being unenforceable.

• Allows defendants to file motions to dismiss claims filed for purposes of forcing individuals or entities to change positions or coerce behavior unrelated to the actual claim.

• Permits dismissal of claims based on allegations made to government entities by anonymous complainants where the complainant is not revealed or made allegations while holding ulterior motives or retaliatory intent against the defendant.

• Requires such dismissal motions to be supported by affidavit when grounds do not appear on the face of the pleading.
