HB3246 - Retail Store Sharps Disposal Act

• Requires retail stores to provide sharps disposal boxes in all restrooms if requested by an employee (written request to manager and Department of Public Health), requested by the municipality, or if needle exposure infection is traced to that store.

• Allows municipalities to require sharps disposal boxes at retail stores within their jurisdiction through local ordinance.

• Mandates that retail stores with sharps disposal boxes must have at least one employee trained in safe handling and disposal of sharps through a Department of Public Health-instituted training program.

• Requires installation and employee training to be completed within 90 days of the requirement notice (or 30 days for stores that unsuccessfully appeal categorization as high sharps-usage locations).

• Directs the Department of Public Health to create and maintain a list of affected retail stores, establish criteria for identifying retail categories with high sharps usage, and conduct annual compliance inspections of required stores.
