HB3292 Summary

• Amends the Business Enterprise for Minorities, Women, and Persons with Disabilities Act to require utilization plans for all solicitations with Business Enterprise Program participation goals, expanding requirement beyond non-construction solicitations only.

• Makes failure to submit a completed utilization plan render a bid or offer non-responsive.

• Requires successful bidders who fail to meet stated participation goals to be notified and given up to 10 calendar days to cure the deficiency by contracting with additional minority or women-owned subcontractors or increasing work assignments to previously identified qualified vendors.

• Prohibits termination of identified certified subcontractors without written consent from the State agency or public institution of higher education awarding the contract.
