Persons admitted to developmental disability facilities receiving habilitation shall have access to sex education, resources, and treatment planning supporting sexual health and protection from exploitation and abuse.

Individuals must be assessed for decision-making capacity to consent to sexual activity and for developmentally appropriate sex education materials, with assessments including medical, psychological, and psycho-social evaluations.

Treatment teams including the individual, relevant professionals, and any appointed guardian determine appropriate sex education materials and the person's capacity to consent, with guardian decisions following Probate Act standards.

Department-approved sex education curriculum must be developmentally appropriate, evidence-based, emphasize abstinence and disease prevention, cover contraception effectiveness, teach recognition of unwanted advances and predatory behavior, and address emotional consequences of sexual activity.

The Department may not deny approval of sex education materials solely because they include or reference religious or faith-based perspectives.
