HB3335 - Carryout Bag Fee Act

• Imposes a $0.10 fee on each carryout bag at retail establishments in Illinois, except in municipalities with populations greater than 1,000,000.

• Distributes collected fees as follows: $0.03 retained by retailers, $0.04 to the Carryout Bag Fee Fund, $0.01 to Prairie Research Institute of University of Illinois, $0.01 to Solid Waste Management Fund, and $0.01 to Partners for Conservation Fund.

• Requires counties and municipal joint action agencies to use their portion of revenue for household hazardous waste collection, recycling/composting programs, and solid waste management implementation, with at least 25% dedicated to waste collection events and centers.

• Exempts carryout bags used for items purchased through the Supplemental Nutrition Assistance Program and similar governmental food assistance programs from the fee.

• Prohibits counties and municipalities from banning or regulating carryout bags, except those charged fees on February 1, 2018 may continue existing programs, and allows existing recycling programs to continue; repeals the act on January 1, 2026.
