• Health care providers must supply patients or representatives with written descriptions of foreseeable health and legal risks and benefits of biochemical testing for controlled substances.

• Written informed consent materials must include information about reasonable alternatives, how to obtain answers about substance abuse treatment, Federal Safe Harbor Protections, extent of confidentiality, and voluntariness of agreement to testing.

• Requires informed permission from parents or guardians in the case of infants undergoing biochemical testing for controlled substances.

• Takes effect immediately upon becoming law.
