HB3646 Summary

• Requires a referendum on November 5, 2020 in each township that is coterminous or substantially coterminous with a municipality to allow voters to dissolve the township and transfer all its rights, powers, duties, assets, property, liabilities, and obligations to the municipality.

• Referendum must be approved by a majority of voters in both the township and the municipality to take effect, with dissolution occurring on the third Monday in May following the next consolidated election for township officials.

• Abolishes all township road districts upon township dissolution, transferring their jurisdiction, authority, rights, powers, duties, assets, property, liabilities, and obligations to the municipality.

• Allows municipalities to hire employees and enter into intergovernmental agreements or contracts with counties, other municipalities, or private contractors to administer roads formerly under the dissolved road district's jurisdiction.

• All provisions related to the November 5, 2020 referendum are repealed on July 1, 2023; makes conforming amendments to the Property Tax Code, Illinois Public Aid Code, and Illinois Highway Code.
