IL HB3935

Renumbers Section 22-85 to Section 22-88 of the School Code regarding parental notification when law enforcement detains and questions students on school grounds.

Requires law enforcement officers, school resource officers, or school security personnel to notify or attempt to notify a student's parent or guardian before detaining and questioning a student under 18 years old suspected of committing a criminal act on school grounds.

Mandates documentation of the time and manner of parental notification or attempted notification and requires reasonable efforts to have the parent or guardian present during questioning, or if absent, to have school personnel such as a social worker, psychologist, nurse, or counselor present.

Requires that when practicable, a law enforcement officer trained in youth interactions or a juvenile police officer be present during questioning of the student.

Exempts the requirements when urgent and immediate action is necessary to prevent bodily harm, apprehend an armed or fleeing suspect, prevent evidence destruction, or address an emergency or dangerous situation.
