HB3973 Summary

• Allows private nonprofit special education facilities in Illinois that serve only students referred by public school districts to require monthly tuition payments from school districts prior to providing services.

• Requires private special education facilities to refund school districts any tuition collected for days students were not enrolled at the end of each regular and summer school term.

• Requires the State Board of Education to order refunds of tuition for any days a facility is found in noncompliance with special education rules, upon request of the school district.

• Applies effective immediately upon enactment.
