IL HB3975

Prohibits school district employees, volunteers, and independent contractors from placing any student in seclusion, defined as confinement in an enclosed space (box, closet, room, or any locked/unlocked space) used as a discipline or behavior management technique

Applies to all students, including those with disabilities receiving special education services under Article 14 of the School Code

Exempts court-ordered placements outside of school district educational programs and placements in facilities governed by other laws or rules

Requires the State Board of Education to promulgate rules implementing the seclusion prohibition

Retains existing physical restraint provisions allowing restraint only when a student poses physical risk to self or others, no medical contraindication exists, and staff are trained in safe application
