HB4248 Summary

• Amends the Motor Fuel Tax Law to allow Grade Crossing Protection Fund transfers to fund maintenance of safety treatments that deter trespassing on railroad property, in addition to existing uses.

• Removes the previous $2,000,000 annual cap on Grade Crossing Protection Fund moneys allocated for pedestrian walkways.

• Authorizes the Illinois Commerce Commission to approve and order safety treatments requested by public authorities or rail carriers to deter trespassing at railroad properties outside of public crossings, after a hearing or by stipulated agreement.

• Modifies the Illinois Vehicle Code to establish the Commission's authority to determine the terms of installation, operation, maintenance, and use of anti-trespassing safety treatments at non-public crossing locations.
