HB4284 - Electric Vehicle Charging Act

• Creates the Electric Vehicle Charging Act requiring new or renovated residential and nonresidential buildings with parking to install electric vehicle charging infrastructure based on building size and type.

• Residential buildings must have 100% of parking spaces electric vehicle ready (1-6 spaces), 100% capable with 20% ready (6-23 spaces), or 100% capable (24+ spaces), with requirements reduced 2% for each space with charging equipment already installed.

• Nonresidential buildings must have 30% of total parking spaces electric vehicle ready.

• Condominium unit owners cannot be prohibited from installing electric vehicle charging stations in their units or designated parking spaces; associations must approve applications within 60 days or applications are deemed approved, with owners responsible for installation costs, maintenance, electricity, liability insurance, and disclosure to future buyers.

• Tenants may install Level 1 or Level 2 electric vehicle charging systems at their expense; landlords may charge only for actual electricity costs, installation costs if landlord performs work, or reasonable parking space reservation fees, and cannot prohibit installation under bona fide safety or reasonable aesthetic requirements; willful violations by associations or landlords subject to civil penalties up to $1,000 and attorney's fees.
