Teachers who become pension system members after the effective date and are determined through an administrative hearing to have sexually abused a student would forfeit all pension benefits under both the Downstate Teacher and Chicago Teacher pension systems

Employers are required to notify the pension board when a retiring member has been accused of sexually abusing a student

Pension boards gain authority to conduct administrative hearings to review sexual abuse claims and order benefit forfeiture based on their findings

The forfeiture provisions do not apply to members who joined before the effective date, preserving existing vested rights and contracts, while still allowing members to receive a refund of their contributions

The act takes effect immediately upon becoming law, with all teachers entering service after that date deemed to have consented to these provisions as a condition of membership
